The Mortgage Disclosure Improvement Act (mdia)

The Mortgage Disclosure Improvement Act goes into effect on July 30, 2009. Please understand that this is federal legislation that could affect your closing date. All mortgage professionals must comply with the requirements as noted below. A loan cannot close or fund unless it has met the requirements listed below. The requirement is applicable for all mortgage loans (unless exempted as noted below). It has been implemented to protect the consumer, but it could cause delays in the closing.

On July 30, 2008, Congress enacted the Housing and Economic Recovery Act of 2008 (HERA). Within HERA, Congress included amendments to TILA which are known as the Mortgage Disclosure Improvement Act of 2008 (MDIA). On October 3, 2008 Congress further amended the Mortgage Disclosure Improvement Act as part of the enactment of the Emergency Economic Stabilization Act of 2008 (Stabilization Act). With the enactment of HERA and the Stabilization Act, the Federal Reserve Board is now amending Regulation Z with all provisions of the MDIA and making these changes effective as of July 30, 2009.

The immediate changes you need to know about MDIA requirements are as follows:

1. MDIA implements a 3-7-3 rule that creates new timing and waiting requirements with regard to the issuing of Truth-in-Lending disclosures and when closing can occur. The 3-7-3 rule requires the lender to:

a. Upon the taking or receipt of a loan application, provide an initial Truth In Lending(TIL) to the borrower(s) within 3 business days of the application (no change to current requirement).

b. Impose a waiting period BEFORE allowing a mortgage loan to close. The waiting period requires a lender to wait until the 7th business day following the delivery or mailing of the initial TIL to the borrower(s) before a creditor may close any loan. The 7 day period may be waived only if there is a bona fide and/or extreme and/or urgent reason to do so. This would be handled in the same manner as a waiver of rescission, which is virtually impossible to achieve. Therefore, there will be virtually no waivers of the 7 day waiting period.

c. Impose an additional 3 day waiting period before a loan may close in any instance in which the Truth In Lending(TIL) is outside of regulatory tolerances (e.g., for regular or fixed rate loans more than .125% and for irregular loans more than .25%). The 3 day period begins with the mailing of the TIL. A corrected TIL is required whenever a TIL is outside of regulatory tolerances.

d. The TIL may be mailed via regular mail or overnight or by e-sign or e-mail. However the lender sends the TIL, they must still comply with the 3 day waiting period. MDIA does not assume a quicker waiting period might occur and does not allow the lender to proceed until after the 3 day waiting period has ended.

2. Lenders can under no circumstances collect any upfront fees prior to the consumer's receipt of an accurate TIL unless the fee is to cover the cost of the consumer's credit report.

a. The fee collected must be bona fide and reasonable (no padding of fees and do not collect a fee unless the consumer is actually responsive if there was no intent to charge them for the credit report).

b. A lender and third party such as a broker must adhere to the same rules regarding the collection of fees. If a third party forwards a consumer's written application to a lender, both the lender and third party do not collect any fee, other than a credit report fee if a credit report was pulled.

c. If a third party forwards a consumer's written application to a second creditor following a prior creditor/lender's denial of an application made by the same consumer (or following the consumer's withdrawal), where fees have already been assessed, the new creditor/lender or third party does not collect or impose any additional fee until the consumer receives an initial TIL from the new creditor/lender.

3. An initial Truth-in-Lending disclosure must now be issued on a closed-end principal dwelling and a second home whether transaction is a home purchase transaction, a new construction loan, or a refinance. Previously, initial TIL's were not required on refinances. The changes continue to exclude issuing an initial TIL on an investment property loan or a HELOC.

a.. For a primary residence, any non-owner occupant must also receive a copy of any TIL that is issued.

4. A new required "Notice" will be added to the TIL advising a consumer they are not obligated to proceed with the loan if they do not wish to do so.

5. No initial TIL is required if a consumer withdraws or is denied within 3 days receipt of the loan application.

6. Under the amended rules, a business day is any day other than Sunday or a legal holiday - which is the same as the current rescission day definition.

7. Any waiver of the 3 or 7 day waiting periods must be treated the same as waiving rescission. There must be a bona fide emergency before a waiver request will be considered.

a. A waiver when granted may not be a preprinted letter. The borrower(s) must handwrite a request to waive the 3 day or 7 day period and must describe the bona fide emergency.

b. Any waiver requested and granted must be signed by all parties that take part in the transaction.

8. MDIA does not amend any requirements specific to HELOC loans.

After you've started cleaning and you realize that rust still remains, you need to take more steps to clean it. Once you're satisfied that the rust is history, apply a rust resistant primer. After the primer dries, apply an acrylic base paint. Strips of meshing is then embedded into the acrylic base, then smooth the wrinkles out. After that dries, apply a coat of acrylic primer followed by a minimum of two acrylic topcoats.

Some have attempted to patch the holes in metal roofs by soldering pieces of metal over them. However the success of this process varies greatly. If you're adamant about keeping the tin, or metal, roof, it may be easier to replace it.

A Metal roof will cost more as opposed to a more conventional roof, and the technology has improved over the years. The properly installed metal roof will last longer, have more durability and the problems of the past no longer overwhelm the home or business owner.

Those past problems of leaking and noise are gone as well. However the solid tin roof has had its own history, and no longer will be seen in this modern world, probably due to cost and availability. When you find a person that renovates the historic past and when they want the tin roof restored to its original beauty, they probably won't settle for anything other than the historic tin roof.

The next method that you can use to assist your child in developing fine motor skills is to allow them the opportunity to cut out shapes and designs with scissors. This is a great exercise for strengthening all of those small muscles in the hands, and the wrists. It is also beneficial in developing the overall hand/eye coordination. Allowing children to engage in activities like Connect the Dots and tracing different types of pictures is another fun and exciting way to fine tune the skills when it comes to fine motor skills. All patients underwent 7 standardized sessions of Osteopathic manipulative treatment with each therapy session lasting 20 minutes. After the end of treatment session, almost 82% patients who underwent chiropractic therapy reported improvement in breathing symptoms with statistically better profiles of forced expiratory flow, mid-expiratory phase, vital capacity and airway resistance. No significant complications were reported in any patient.

Cheryl Hawk presented another research study that was published in the Journal of Chiropractic Medicine that was conducted on elderly patients to decrease the risk of falls. This study was small scaled and conducted on only 10 patients with mean age of 60 years or above in whom the coordination and balance was poor (marked by frequent history of falls). All patients were subjected to 16 sessions of chiropractic spinal manipulation and assessed on Berg Balance Scale (BBS). At the end of therapy, most of the patients reported improvement of symptoms and a BBS score of less than 45 (before therapy almost all the patients had a BBS score of greater than 45), indicating marked improvement of symptoms.

Chiropractic adjustments are generally safe in elderly patients; however, it is primarily indicated to speak to your primary chiropractor for a preliminary assessment of your medication condition and overall bone health. The most common contraindications for chiropractic adjustments include elderly patients with advanced osteoporosis or altered bone mineral density, patients with history of bone tumors or signs of metastatic bone diseases, and patients with uncontrolled diabetes.

Your inner guidance system has a vested interest in allowing you to feel good and you should trust your inner feelings even when they go against logic (perhaps, especially when they go against logic!)

1. Make a point of doing something every day which makes you feel good. It may be stealing an extra 10 minutes in bed in the morning (careful not to overdo it as rushing out to work without your breakfast certainly won't improve your mood!), enjoying a coffee with a friend at lunchtime, listening to a favourite song or just spoiling yourself with a relaxing bath in the evening. It doesn't need to be anything big or significant but will just help to raise your emotional vibrations into the happy end of the scale.

2. Likewise, make a point of eliminating things in your life which do not feel good. If it's something you really can't avoid, don't dwell on it or worry about it, just do it and get it over with. If it's something you can delegate or get away without doing, so much the better. Remember, just thinking about something which makes you worried or anxious is setting up the wrong vibrations and will attract more of the same.

3. Lastly, stop worrying about what others think. It may cause some friction if your way of thinking doesn't match that of the people around you but you can't make anyone else happy. We must each do what makes us feel good and we can only be responsible for our own happiness. The best we can do for others is to set a good example!

How To Install Pergo Laminate Flooring

So you want a Pergo floor, but now you need help installing it. This brief tutorial on installing laminate flooring lays out a step-by-step pathway for your home improvement adventure. You can purchase Pergo at any Denver wholesale flooring store, or home improvement center.

Materials:
Pergo Laminate Flooring
Laminate Edging
Saw (jigsaws and radial arm saws work best)
Measuring Tape
Hammer
Tapping Block
Spacers
Pull Bar
Wood Glue (optional)

Step 1: First, you will need to determine the amount of Pergo flooring and edging you will need for the area you are covering. Multiply the length by the width of the selected area, and this will give you the square footage of Pergo that you'll need. Measure only the sides of the flooring that make contact with carpet, or separate rooms for your edging. Always plan on purchasing more flooring than you think you will need. Chances are mistakes will be made, and this way, unnecessary trips to the store will be avoided.

Step 2: Determine which direction you would like to lay your Pergo planks. Most of the time, it is easier to lay the planks lengthwise in the room, but it is a matter of personal preference. If you do lay the planks width-wise to the room, be aware of the increased amount of trimming that will take place. Also, allow extra space around the sides that need edging pieces (specific measurements for this will be provided in the individual boxes of Pergo and edging packages).

Step 3: Install the flooring underlay by laying it in strips that are touching, but not overlapping. Some Pergo or other laminate flooring has flooring underlay already attached to each individual plank; in this case, you can forego the separate installation of the underlay. The purpose of the underlay is to prevent the floor from making direct contact with the floor underneath; it also reduces noise and makes the floor generally softer.

Step 4: Start installing the first row with the tongue side of the boards facing the wall. Don't forget to insert spacers around the perimeter of the chosen area as you go, so there is some space for the boards to "breathe" and acclimate to hot and cold temperatures. Make sure you lock the short sides together first, and use the pull bar and hammer at one end to gently close any gaps. The spacer should keep you from moving the whole row too close to the wall.

Step 5: Proceed with the second row of Pergo, only using two-thirds of the first board so as to create a "staggered" effect. Also: make sure to cut the correct end of the board before trimming it, depending on whether you need the tongue or groove side to attach the rest of the boards in that row. Insert the long tongue side to the first row, and continue down the second row with full boards, while inserting the short tongues in first. Tap in the long tongue sides with the tapping block and hammer until you reach the last board. Trim as necessary.

Step 6: Proceed with the rest of the rows, and continue staggering each row to give it more of a real "hardwood" feel. After the last board is installed, install any necessary floor transitions (e.g. edging pieces), and re-install floor molding, heat registers and doors.
